Bankruptcy and restart

A company can end up in financial distress for many reasons. Bankruptcy is then sometimes inevitable. With the correct preparation, we ensure that the consequences of a possible bankruptcy are limited as possible. When there is a case of bankruptcy, it is important to keep control. If possible and desirable, we work towards a restart of the company.

Optimal protection

Every company can face bankruptcy in its existence. It is, therefore, useful to set up a corporate structure that offers the best protection in the event of bankruptcy in the future. Protection usually means shielding as many (private) assets as possible.

We provide support in setting up such structures. Preparations are best made when there are no financial problems yet. Nevertheless, we can also assist you when your company is already in heavy weather.

Controlled bankruptcy

When bankruptcy is unavoidable, it is important to keep as much control as possible. We can provide clear insight into specific risks and ensure that a plan of action is available. After proper preparation, we enter into constructive consultations with the liquidator, banker, and other parties involved, so that the effect of the bankruptcy is limited as much as possible. We gladly guide you through this process.

Restart

Bankruptcy does not necessarily mean the end of your business. The company may be able to be continued through a restart. In a way, bankruptcy can even be considered advantageous, as the company can be reshaped and debts can be restructured.

A good plan is necessary for the realization of a successful restart. In such a plan, particular attention should be paid to the financing of the restart and the viability of the company after the restart.

The financing of the restart usually provides the funds needed for:

  • buying back the necessary assets from the liquidator;
  • working capital;
  • making arrangements with creditors with rights of pledge and/or mortgage.

We have extensive experience in realizing a restart and can support you in developing a restart plan, obtaining restart financing, and making arrangements with the liquidator or creditors. Our advisers gladly assist you.
